Staff Analysis of the Legislation

HB 842 amends Chapter 1 of Title 31 of the OCGA to prohibit healthcare service providers from discriminating against potential organ transplant recipients solely because of his or her physical or mental disability. An individual’s disability may only be taken into account when it is deemed by a physician to be medically significant. Affected individuals may file a civil action for injunctive and other equitable relief in the individual’s county superior court. Actions of this sort must be given priority on the court’s docket and expedited for review. 

The bill further amends Chapter 24 of Title 33 to also prohibit health insurers from denying or limiting coverage for potential organ transplant recipients solely for his or her physical or mental disability. This does not apply to coverage for a medically inappropriate organ transplant.
